The first wrongful death lawsuit has been filed for the deadly stage collapse before a Sugarland concert at the Indiana State Fair earlier this month. Seven people have now died from the incident and nearly 40 people were severely injured, including the woman who has filed the lawsuit.
The woman is suing Live Nation, the state of Indiana, Lucas Entertainment Group, and Mid-America Sound Corp. for the shotty construction and planning of the stage that killed her wife. She believes if the stage had the proper permits, followed OSHA procedures, and if the state heeded severe weather warnings her partner would still be alive.
The lawsuit will test Indiana’s gay marriage ban. Since same-sex marriage is illegal in the state, the woman may not see anything from the possible $50 million suit since only next of kin and spouses can receive benefits. They were married in Hawaii and have raised a 17 year-old daughter together.
