A toxic tort is a type of lawsuit that is filed against a manufacturer, distributor, or similar party who is responsible for a dangerous chemical which has caused an injury. Typically, the types of chemicals involved are exposed to the victim during the course of his or her job, where the worker may either be unaware of the exposure, or the employer may not provide enough protection from the toxic chemicals.

Another common type of toxic tort involves pharmaceutical products. In 2004, Merck recalled the pain relieving medication, Vioxx, from the market due to its increased risk of heart attack and stroke, and was subsequently subjected to a number of toxic torts. Pharmaceutical companies are responsible for adequately informing patients and doctors about the potential side effects of their medications, and if they fail to do so, they may be liable for injuries that result.

Additionally, you may be exposed to toxic chemicals because of a poorly built house or one that uses unacceptably toxic chemicals. People may also come into contact with hazardous chemicals through mediums such as contaminated air or water, which can often occur in houses and apartments situated next to manufacturing or waste processing plants. Although these chemicals may be a known risk, companies still have a responsibility to minimize that risk to others and if they do not, they may be liable for their actions.
