Judge rules on OSHA fall hazard citation

Posted on November 8th, 2012 No Comments

A judge has recently ruled on a fall hazard case regarding a safety violation that lead to the death of a worker. The Occupational Safety Health Administration made a ruling on the matter and an Ohio judge has upheld this decision.

The Ohio-based company, M & J Painting was cited for six violations regarding the painting and cleanup of a bridge in Fall River. After officials inspected the site, they cited the company with the violations and the company hasĀ  contested one of them.

The violation in question was related to horizontal lines that the company did not have at the site. OSHA ruled that the lack of these lines could lead to a serious fall that could cause injury or worse to a worker.

The company was also cited for failure-to-abate after it was found that the did not originally correct the issues they were cited for. The company fought against this violation, but an administrative law judge recently made a ruling that the company is responsible for the fines associated with the hazards. The fine that was contested totaled to the amount of $19,250.
