Judge Overturns Jury Decision in Workplace Injury Suit

A Cincinnati judge last month overturned a jury's decision not to award any money in the case of a serious workplace injury.  The case's plaintiff, a rail yard worker, was horribly injured when a 176-pound safety valve he was standing over while working on a pressurized rail car failed, sending the heavy metal valve slamming into his head.  The injury was so sever it left him able to communicate only through raising and lowering one of his thumbs.

According to the judge, he had failed to properly explain to the jury the responsibility of the rail company and chemical company to keep the container car in safe working order.  The judge's ruling to overturn the jury's decision was his last before moving up to Ohio's 1st District Court of Appeals.
