Illinois man receives $4.16 million settlement in injury lawsuit

An Illinois garage door repairman has received a $4.16 million settlement after sustaining serious injuries while performing an inspection in the city of Elmhurst.

Joshua Jaeger suffered severe injuries in November 2009 after falling 16 feet from a platform that was dangerously situated atop a forklift while fall injury formulating an estimate for a damaged garage door spring at the Elmhurst Public Works building. The fall was determined to be a result of negligence on the part of the city, who did not provide Jaeger with a safe way to inspect their premises. The Centers for Disease Control and Prevention report that workplace fall accidents are one of the most common kinds of injuries, with related workers’ compensation and medical costs totaling more than $70 billion annually.

Instead of a ladder or other safe platform Jaeger could have used to perform his duties, the city situated a platform on a forklift and elevated him on it. As he moved from one side to the other, the platform’s balance failed and it fell off of the forklift, taking Jaeger with it. Jaeger’s femur was fractured and his back sustained soft tissue damage as a result of his fall. The city originally denied negligence and claimed his injuries were not severe enough to cause him future distress. It also argued that his lost income was insignificant because he worked for a small, family-owned business.

The lawsuit reached its conclusion earlier this week. Jaeger received compensation for lost earning potential, pain and suffering, and loss of a normal life. His attorney made the accurate assessment that while this large settlement might seem like a tremendous windfall for Jaeger, it’s merely¬† just compensation for the damage the city caused to his life and future prospects, getting right to the heart of personal injury law practice. Jaeger’s life will never be the same as a result of the injuries he sustained due to the city’s negligence. He has been stripped of his bright future and forced to live the rest of his life coping with pain and disabilities.
